Se abstuvo de resolver el conflicto de competencias suscitado entre el Juzgado 3º Civil Municipal de la Dorada -Caldas- y el Juzgado 39 Civil Municipal de Bogotá, toda vez que es la Corte Suprema de Justicia, Sala de Casación Civil, quien debe dirimir el conflicto por ser el superior jerárquico común de los dos despachos judiciales.

En consecuencia, se remite el expediente a la citada Sala de la Corte Suprema de Justicia, para lo de su competencia.

  1. Primero. ABSTENERSE de resolver el conflicto de competencias suscitado entre el Juzgado 3o Civil Municipal de la Dorada -Caldas- y el Juzgado 39 Civil Municipal de Bogota.
  2. Segundo. DECLARAR que la Corte Suprema de Justicia, Sala de Casacion Civil, es la autoridad competente para decidir el conflicto de competencias suscitado entre el Juzgado 3o Civil Municipal de la Dorada (Caldas) y el Juzgado 39 Civil Municipal de Bogota.
  3. Tercero. REMITIR, por medio de la Secretaria General de esta Corporacion, el expediente a la Corte Suprema de Justicia, para lo de su competencia.
